1. Company Introduction and Data

This text forms the Legal Notice for the website owned by Serveo Servicios, S.A.U. under the domain names "serveoservicios.com", "serveo.com", "serveo.es" and their respective subdomains (hereinafter, the "Website").

Serveo Servicios S.A.U. is an entity whose registered office is located at Calle Quintanavides 21, Edificio 5, 28050 Madrid, with CIF A-80241789. Registered in the Mercantile Registry of Madrid under volume 2,081, page 134, page M-36972 (hereinafter, the "SERVEO" Website).

2. Purpose and Scope of Application

This Legal Notice governs the access and use of the content offered by SERVEO through its Websites. However, SERVEO reserves the right to amend the Website's presentation, configuration, content and services, as well as the conditions required for access and/or use.

Nevertheless, access to certain content and the use of certain services may be subject to Specific Conditions, which, depending on the case, will replace, complement and/or amend this Legal Notice, or the General Terms and Conditions and, where appropriate, Specific, with the contradictory terms of the Specific Conditions prevailing over the General Terms and Conditions and the Legal Notice.

The mere access, browsing and use of the Website entails and supposes the User's acceptance of the Legal Notice in force and published at all times.

In this sense, a User will be understood as the person who accesses, browses or views the content hosted on the Website and a Registered User will be understood as the person who accesses, browses and registers to, use, view, browse, host and/or download the content and/or use the services of the Website.

Accessing and browsing the Website does not require registration, with the exception that data such as name and email address may be required to use certain functionalities.

Users agree to:

  • Accept and comply with the provisions of this Legal Notice, and in any document that forms an integral part of it.
  • Not defame, abuse, annoy, harass, threaten or violate – or in any other way – any rights of other Users or any other person.
  • Not to remove or attempt to remove any security measures adopted and implemented on the Website.

SERVEO owns or has obtained the corresponding licence on the rights to operate the intellectual and industrial property of the Website, as well as the intellectual and industrial property rights over the information and materials, the structure, selection, arrangement and presentation of its content, services and products available through it, and the computer software used in connection with it.

A User accessing, browsing, using, hosting and/or downloading the Website's contents and/or using its services shall in no case be understood as a waiver, transmission, licence or total or partial assignment of the rights as indicated above by SERVEO or, where appropriate, the owner of the corresponding rights.

Consequently, it is not allowed to delete, evade or manipulate the copyright notice or any other data identifying the rights of SERVEO or their respective owners included in the contents and/or services, nor the technical protection devices or any information and/or identification mechanisms that may be contained therein.

References to names, brands or registered trademarks, logos or other distinctive signs, whether owned by SERVEO or third-party companies, implicitly prohibit their use without the written consent of SERVEO or their legitimate owners, as appropriate. At no time, unless expressly stated otherwise, does accessing or using the Website and/or its contents and/or services grant Users any right over the trademarks, logos and/or distinctive signs included in it, as protected by Law.
All intellectual and industrial property rights are reserved and it is specifically prohibited to amend, copy, reuse, exploit, reproduce, transform, publicly communicate, make second or subsequent publications, upload files, send by mail, transmit, use, treat or distribute all or part of the contents and products included on the Website in any way for public or commercial purposes if you do not have express written authorisation from SERVEO or, where appropriate, the owner of the corresponding rights.  

 

5. Licence on Communications

Should Users send information of any kind to SERVEO through the Website, using the channels provided for this purpose, Users declare, guarantee and accept that they have the right to do so freely; that the information does not infringe any intellectual property right, trademark, patent, trade secret, or any other third party right; that the information is not confidential and that the information is not prejudicial to third parties.

Users acknowledge assuming liability and will not hold SERVEO at fault for any communications provided personally or on their behalf, taking on said liability with no limitation to the accuracy, legality, originality and ownership of it.

 

6. Responsibilities and Guarantees

The contents of the Website are provided for informational purposes and are not intended to constitute any investment, transaction or similar recommendation.

SERVEO declares that has taken all the necessary measures within its capacity and technology status to ensure the Website's operations and avoid the existence and transmission of viruses or any other damaging components to Users.

However, SERVEO does not guarantee the suitability or usefulness of the Website's content, nor is it liable for any damages or losses caused, to itself or a third party, by any person who infringes the conditions, rules and instructions put in place by SERVEO on the Website or through breaching the Website's security measures.

Should Users become aware of any content that is unlawful, illegal, contrary to law or that could imply an infringement of intellectual and/or industrial property rights, they should notify SERVEO immediately so that the appropriate measures can be taken.

7.1. Links to other websites

SERVEO will not be liable for any aspect related to third-party website to which a link could be made from the Website, specifically, including but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents in general.

Any type of link from the Website to another external website will not imply that there is any relationship, collaboration or dependency between SERVEO and the person/company responsible for the external website.

7.2. Links on other websites to the Website

Should any User, entity or website wish to have any type of link to the Website, they must abide by the following stipulations:

  • The link must be implicit and complete, i.e., it must take Users, through a single click, to the URL of the Website itself and cover the entire extension of the screen of the Website's Home Page. Unless expressly authorised by SERVEO in writing, the Website that establishes the link shall not reproduce the Website in any way, nor include it as a part of their Website or inside one of their "frames" or create a "browser" of any of the Website's pages.
  • The page that establishes the link shall not declare that SERVEO has authorised the link in any way unless SERVEO has done so expressly and in writing. Should any entity that correctly establishes the link from their page to the Website wish to include the trademark, corporate name, trade name, tag, logo, slogan or any other identifying element of SERVEO and/or the Website on their website, they require the express written authorisation from SERVEO.
  • SERVEO does not authorise links to the Website from web pages that contain illicit, illegal, degrading, obscene materials, information or content and, in general, that contravene morality, public order or generally accepted social norms.

The Website's Privacy Policy and Cookies Policy are determined by what is established in the Privacy Policy and Cookies Policy documents.

 

9. Duration and Amendment

SERVEO shall be able to amend – in full or in part – the terms and conditions established herein, posting any change in the same manner that appear in this Legal Notice and through any type of communication addressed to Users.

The validity of this Legal Notice therefore coincides with its time of exposure, until it is amended in full or in part, at which time the amended Legal Notice published on this Website will become valid.

Notwithstanding the content of the specific conditions, SERVEO may terminate, suspend or interrupt access to the Website's content at any time and without prior notice and Users shall not be entitled to demand any kind of compensation. Upon termination, the prohibitions on the use of the content set forth above in this Legal Notice shall remain in force.

 

10. General Considerations

The headings of the different clauses are only for information purposes and shall not affect, qualify, or expand the interpretation of this Legal Notice.

In the event of any discrepancy between the content of this Legal Notice and the Specific Conditions of any specific service, the content of the latter shall prevail.
Should any provision or provisions of this Legal Notice be deemed void or non-applicable, in full or in part, by any Court or competent administrative body, said nullity or non-applicability shall not affect the other provisions of this Legal Notice.

The non-exercise or execution by SERVEO of any right or provision contained in this Legal Notice shall not constitute a waiver of it unless expressly stated in writing by them.

 

11. Jurisdiction and Applicable Legislation

SERVEO's Website and its content will be governed by the provisions of Spanish law.

The relationships established between SERVEO and Users shall be governed by the provisions of current regulations regarding applicable law and competent jurisdiction. However, for cases where the regulations provide for the possibility of the parties submitting to a jurisdiction, SERVEO and Users – expressly renouncing any other jurisdiction that may correspond to them – shall submit any issues and/or disputes to the Courts of the city of Madrid, with Spanish law being applicable.
